
Terms and Conditions
These terms and conditions govern the operation and function of Club 94 Pty Ltd, an Australian registered company. Nothing in these terms and conditions limits any rights you may have under the Australian Consumer Law, Fair Trading Act, or any other Commonwealth or State legislation. Any terms or conditions that create an inconsistency with relevant legislation are considered void to the extent of the inconsistency.
This agreement applies to all customers who make a purchase either at a Club 94 gym or via the Club 94 app or website. Club 94 has no obligation to issue a tax invoice unless requested or required by law. Club 94 is not liable for any of its products that have been on-sold by a customer to a third party.
1. Binding Agreement
By accessing or using Club 94’s facilities, website, or services, you acknowledge and agree that you are entering into a legally binding agreement with Club 94. If you have any questions about these terms, we encourage you to contact us before proceeding.
2. Cooling-Off Period
You have a 7-day cooling-off period from your initial sign-up, during which you can cancel your membership without any fee. Cancellation must be completed in person or via email at admin@club94.com.au for security and identification purposes. If you exercise your cooling-off rights, we will refund all fees paid, and no further charges will apply.
3. Provision of Services
In return for payment of fees, Club 94 provides access to its facilities and services during the membership term. Some services, such as personal training, are not included in the membership and may require additional fees. We take your safety seriously and will ensure that our facilities and services are safe, hygienic, and secure. If you notice any issues with our facilities or services, please notify us immediately. Club 94 may modify or update its facilities and services from time to time without prior notice.
4. Sales, Refunds, and Exchanges
At Club 94, we strive to provide high-quality services and products to our valued members. Please be aware that all sales, including memberships, classes, personal training sessions, upfront payment of memberships, or any products purchased at the gym, are final. We do not offer refunds, exchanges, or cancellations once a transaction is completed, except as required by law.
By making a purchase, you agree to this policy. We encourage you to carefully review all purchases before completing your transaction. If you have any questions or concerns before making a purchase, our staff is available to assist you. This policy is in place to ensure a fair and efficient experience for all members.
5. Membership Termination
Memberships at Club 94 include a Standard membership (with a 12-week minimum term) and a Student membership (no lock-in). Both memberships require 14 days written notice for cancellation, which can be done via email at admin@club94.com.au.
If you wish to terminate your membership after the minimum term, you must provide 14 days written notice. If you cancel before the end of your minimum term (for Standard membership), the full remaining payment of the membership term is due.
Members may terminate at any time for medical reasons by providing a medical certificate stating unfitness for exercise for an extended period.
Club 94 does not provide refunds upon membership termination, and failure to use our facilities does not entitle members to early termination or refunds. If you breach this agreement or behave inappropriately, Club 94 may suspend or terminate your membership.
6. Time Hold and Transfers
You may place your membership on hold for a maximum of four weeks per 12-month period. Requests for Time Hold require a minimum of 7 days' notice. Your Time Hold will start from the date your next direct debit payment is due.
7. Memberships and Cancellations of Classes
Class sizes are limited and may fill up quickly. To cancel your attendance, you must do so via the Club 94 app before the class start time. Failure to attend without cancelling may result in a $5 “no-show” fee, which will be charged to the card linked to your account.
8. Billing and Payment
Club 94’s direct debit payments are managed by Stripe. It is your responsibility to ensure sufficient funds are available in your nominated bank account or credit card to meet the payment. If a payment is returned unpaid, you are responsible for covering the cost of the debit.
9. Security Surveillance
Club 94 uses 24-hour CCTV surveillance at its premises (excluding bathrooms) for security purposes. This does not guarantee against harm.
10. Limitation of Liability
You acknowledge that participating in exercise carries inherent risks. It is recommended that you seek medical advice before starting any exercise program. To the extent permitted by law, you release and indemnify Club 94 from any loss or damage suffered as a result of injury, loss, or damage in connection with the use of our facilities or services.
11. Privacy
Your privacy is important to us. Club 94 will not share your personal information with third parties unless required by law. 12. Intellectual Property Rights
All content, branding, logos, and materials provided by Club 94 are owned by Club 94 and are protected under intellectual property laws. Members and customers may not reproduce, distribute, or use these materials without explicit permission.
13. Code of Conduct
Members must behave respectfully toward staff and other members. Harassment, misuse of equipment, or inappropriate behavior may result in suspension or termination of membership.
14. Changes to Terms & Conditions
Club 94 reserves the right to update these terms and conditions at any time. Members will be notified of any significant changes, and continued use of services constitutes acceptance of the updated terms.
15. Lost or Stolen Property
Club 94 is not responsible for any lost, stolen, or damaged personal belongings while on the premises.
16. Suspension Policy
Club 94 reserves the right to temporarily suspend memberships due to maintenance, emergencies, or operational needs. In such cases, members will be notified in advance where possible.
17. Third-Party Services
Club 94 may partner with external trainers, nutritionists, or vendors, but is not liable for any services provided by third parties.
18. Direct Debit
Request Service Agreement All direct debit payments are handled by Stripe on behalf of Club 94. Ensure you have sufficient funds in your nominated account or card. Any unpaid debits remain your responsibility.
